        I was hit as a pedestrian in Salt Lake City; what are my rights?

        Answer:

        You versus a car; think about it for a second.

        Thousands of pounds of steel and aluminum moving 10, or 20, or 30 miles an hour. Then there’s you. Just you, totally unprotected and likely unsuspecting that disaster is about to strike.

        When those two things collide, who do you think is going to fare better?

        Unfortunately, accidents where pedestrians are hit often result in the most horrific injuries. Pedestrian accidents almost always involve debilitating and long-lasting injuries, including crushing fractures, severe head injuries, and often people getting killed.

        The most important priority is always to get immediate medical treatment. That’s first and foremost. Because Utah insurance policies have no-fault benefits, there should be money there to help you with those early medical bills.

        That no-fault or PIP claim would typically be made on the insurance policy of the vehicle that caused the injuries, as opposed to crashes with multiple vehicles where the insurance runs through the vehicle you’re in. Auto pedestrian accidents are cases where the no-fault insurance runs through the vehicle that hit you.

        As the insured person, you typically have two claims. First, you have a claim for no-fault benefits. In that claim, it doesn’t matter who was at fault in the crash. That claim covers your first $3,000 of medical expenses, some lost wages, and a few other things that the vehicle’s insurance would pay.

        You also have a claim for bodily injury against the vehicle owner. That claim would compensate you for personal injuries that were caused from the collision itself.
