Worst of all, you or your family are hurting from the crash and the pain and problems and it’s just getting worse.
With all of that going on, you need to make some decisions without hurting your potential injury claim. People in this situation are often tempted to just ignore it all and hope it’ll get better, that it’ll all go away. Listen, this wasn’t your fault. You didn’t choose to be here. As bad as things feel right now, there are choices you can make to help your potential case.
Right now, I’m going to share three common mistakes that I see in Utah crashes that involve commercial trucks. Stay with me until the end because you don’t want to miss the last one.
A really common mistake I see all the time people not going to see a medical provider after the crash.
In difficult times like we’re having right now, we’re all worried about the cost of going to see a doctor. Some people think that maybe if they wait, all that pain will just go away, and nobody gets bothered. They try and convince themselves their injuries aren’t really all that bad, “That pain in my back will just go away.”
The problem is, those little pains you’re feeling right now aren’t just going to go away. They’re going to get worse. Listen to me, if you wait to go to the doctor, or worse—don’t go at all—the insurance company is going to use it against you. They’ll say because you didn’t think your injury was bad enough to see a doctor, it’s not bad enough to pay you money. Don’t make that mistake. Go to the doctor and go now.
The next mistake goes right along with the first one. Some people go to the doctor the first time, but then life gets in the way, and they don’t go back in for regular treatments.
For all the reasons it’s critical that you see the doctor the first time, it’s even more critical that you keep going back. If you stop going to the doctor, the insurance company is going to say you got better, you weren’t hurting anymore, or worse, they’re going to say your injuries came from something else.
I get it. Your life’s been turned upside down. It’s a huge, huge inconvenience to go to regular chiropractor visits, physical therapy visits, to go get an MRI, to go in for injections. Nobody wants to do it, but don’t make the mistake, don’t give the insurance company an easy argument that you weren’t hurt as badly as you are.
Finally, one of the biggest mistakes that I hear about is when people give an insurance company a recorded statement without the help of a lawyer. This gives the insurance company a free pass to take a whack at your case before you really even know if you’ve got one.
They want to record you while they ask a bunch of questions about the crash and about your injuries. They want to do it before you hire a lawyer, before you understand what happened in the crash, and before you’re clear about any of your injuries.
Please, please, remember, insurance companies are not on your side. I promise you, they’re looking for ways to hurt your claim. Don’t make this mistake. Don’t give an insurance adjustor a recorded statement without talking to a lawyer first.
