If you’ve been hit by a car as a pedestrian, it’s not going to be very long before you get a call from an insurance adjustor. When they call, they’re going to want to ask you all sorts of questions about the crash: your injuries, what happened, what you were doing, where and when and why.
A common question I get all the time from new clients is, “If I was hit by a car as a pedestrian and I was hurt, should I talk to their insurance company when they call?”
The simple answer is no, don’t talk to them. The insurance company may ask you a series of questions that will feel like a fishing expedition. These questions are designed to elicit answers that can be twisted to lower the value of your case. Even if it wasn’t your fault, they’ll phrase the questions in certain ways that won’t help you.
Don’t talk to them on your own unless you’ve talked to a lawyer and the lawyer has prepared you and told you it’s okay to have the conversation. Or better yet, let your attorney handle it. The beauty of hiring a lawyer is that you just don’t need to worry about it on your own.
